Sean Combs just notched a major legal win as a federal judge dismissed Dawn Richard’s sexual abuse and breach of contract lawsuit, a development that matters to any rights holder watching how quickly civil claims can reshape a catalog-era narrative. The ruling wipes out all 18 causes of action for now, but leaves Richard a path to refile her core claim in state court.
A federal judge tossed 18 claims, but left one door open
U.S. District Judge Katherine Polk Failla dismissed all 18 of Richard’s claims in a decision dated Friday, June 12, saying many were outside the statute of limitations. One key count, tied to the New York City Victims of Gender-Motivated Violence Protection Law, was dismissed without prejudice, allowing Richard to refile in state court.
Judge Polk Failla wrote that the court’s ruling stood apart from its view of the allegations, which she said were “execrable,” adding that the court was compelled to follow the law.
Richard says she will refile in state court
Richard filed her civil case against Combs in September 2024. In her 55-page complaint, she alleged that Combs groped her on numerous occasions, once trapped her inside a locked car for two hours as punishment, and threatened her life.
Richard’s lawyer, Arick Fudali, said in a statement to Rolling Stone that the team plans to refile the case. He said they are encouraged to pursue the primary claim under the gender motivated violence act in state court in New York City.
Combs’ camp frames the ruling as a legal win, not a factual finding
A representative for Combs did not immediately return Rolling Stone’s request for comment, but told Billboard that the dismissal is “an important reminder that allegations are not findings and that courts exist to evaluate claims under established legal standards.”
Richard met Combs while auditioning for his MTV series Making the Band, later joining Danity Kane with Aubrey O’Day, D. Woods, Aundrea Fimbres, and Shannon Bex. After Combs effectively dismantled the group during the Making the Band 4 finale in 2008, he kept Richard in the Bad Boy orbit by placing her in Diddy-Dirty Money with Kalenna Harper.
What Richard alleged while working around Combs
Richard said that from 2004 until her music career with Combs ended in 2012, she witnessed disturbing behavior, including Combs holding meetings in his underwear, groping her breast area and “bare buttocks,” and making degrading and sexist remarks.
She also alleged that Combs once tried to punch her after she told him not to call her a bitch, and that a bodyguard forced her into one of Combs’ cars before she was locked alone in a freezing vehicle for two hours. Richard said she was only let out after calling her father, who came to the studio and demanded that Combs release her.
