A Houston man named Javon Gilbert, was on probation after setting his girlfriend’s house on fire while was in it. The first-degree felony of arson usually is a much more harsh sentence that can include life in prison but Gilbert somehow managed to avoid the maximum punishment of life in prison. At the time Gilbert pleaded guilty in 2015 without an agreement, and Judge Frank Price sentenced him to eight years of deferred adjudication probation instead.
If Gilbert had stayed out of trouble for eight years, he would not have had the probation or arson on his record, authorities state. Yet he eventually killed his ex-girlfriend by shooting her in the head in 2020 while still on probation. Emmishae Kirby, 29, had disappeared from West Houston and an extensive search was formed. Her body was later found in a ditch with a gunshot wound to the head.
